Judgment

Mr. A.G. Momin, learned counsel for the petitioners has submitted at the outset that the petitioners have approached this Court with a limited prayer only for a direction for early disposal of Misc. Case No. 1 of 2023, pending in the Court of the Court of the learned Additional Judge, District Council Court, Tura. He further submits that the said application has been filed as far back as on 04.04.2023, and only recently i.e. on 14.03.2024, the same has been taken up for consideration. He therefore, prays that as there is some urgency in the matter, appropriate directions be issued for expeditious disposal of the same.
Mr. P.T. Sangma, learned counsel who has entered appearance today on behalf of the sole respondent submits that there is no urgency, and what the petitioners are seeking is to frustrate the Probate proceedings.
Heard the learned counsels for the parties.
Notwithstanding the objections raised by the learned counsel for the respondent, considering the fact that the Misc. application has been filed as bar back as on 04.04.2023, it is expected that the Court of the learned Additional Judge, District Council Court, Tura, take up the matter and dispose of the same as expeditiously as possible, by giving short dates. The parties are also to cooperate.
With the above directions, this matter stands closed and is accordingly disposed of.
