ORDER

This assessee’s appeal for assessment year 2013-14, arises against the Commissioner of Income Tax (Appeals)/National Faceless Appeal Centre [in short, the “CIT(A)/NFAC”], Delhi’s DIN and order no. ITBA/NFAC/S/250/2024-25/1069276453(1), dated 30.09.2024 involving proceedings under section 147 of the Income-tax Act, 1961 (hereinafter referred to as ‘the Act’).

Heard both the parties. Case file perused.

2 For the reasons stated in the assessee’s condonation averments, delay of 412 days in filing of the instant appeal is condoned in light of Collector, Land & Acquisition vs. Mst. Katiji & Others (1987) 167 ITR 471 (SC).

3.

Coming to the assessee’s sole substantive grievance raised in the instant appeal, it is noticed that she is aggrieved against the learned lower authorities’ action treating her investments of Rs.20,96,950/- made in purchase of the immovable property in question which stands restricted to Rs.2,96,250/- in the lower appellate discussion.

4.

That being the case, the Revenue could hardly dispute that such an amount of Rs.2,96,250/- could indeed be held as the assessee’s savings keeping in mind her socio-economic status. The impugned addition stands deleted therefore.

5.

This assessee’s appeal is allowed.
