Augustine George Masih, J.—Counsel for the petitioner very categorically admits that the last contractual appointment of the workman would have come to an end on 31.12.2004 and since the work was still continued at the time when his services were terminated, the workman would be entitled to reinstatement in service but the Labour Court has granted full back wages till the date of expiry of his contract.

I have gone through the award passed by the Labour Court. The Labour Court while granting relief to the workman held him entitled to full back wages for the remaining period of contractual appointment i.e. from the date of his termination till the expiry of the contract that being 31.12.2004.

In this view of the matter, no interference is called for in the award dated 01.10.2007, passed by the Labour Court, Union Territory, Chandigarh, and the writ stands dismissed.

Counsel for the petitioner states that since the workman had continued with the management for a considerable period i.e. four years and the vacancies have still been advertised by the management, and if the petitioner applies to the management, the same be considered sympathetically.

In case, the workman applies in pursuance of the advertisement, his application be considered sympathetically.
