This matter is taken up through hybrid mode.
Heard learned counsel for the Petitioner and learned counsel for the State.
The Petitioner is in custody since 02.04.2024 in connection with Airfield P.S. Case No. 91 of 2024 corresponding to C.T. Case No. 300 of 2024 pending before the Court of learned J.M.F.C.-I, Bhubaneswar for the alleged commission of the offence under Section 380 of IPC.
It is alleged that the petitioner deceitfully withdrew a sum of Rs.2,28,900/- using the ATM card of the informant along with a cell phone. In course of investigation, cash of Rs.4,000/- was recovered from his possession. It is submitted that charge sheet has already been submitted.
Under such circumstances, I find no justified reason to detain the petitioner in custody any longer. The bail application is therefore allowed.
Let the petitioner be released on bail subject to deposit of cash security of Rs.20,000/- which shall be without prejudice to the rival claims and on such terms and conditions as the court in seisin over the matter may deem fit and proper to impose including the condition that he shall personally appear before the trial court on each date of posting of the case without fail.
The BLAPL is accordingly disposed of.
Issue urgent certified copy as per rules.
