Judgment
Jaswant Singh, J.—Prayer u/s 438 Cr.P.C is for grant of anticipatory/pre arrest bail in case FIR No. 65 dated 5.11.2010 u/s 379 IPC, P.S Dharamgarh,District Sangrur.
As per allegations, Takha Singh is alleged to have redeemed his land on 16.6.2010, however, Lal Singh armed with .12 bore gun with the help of co-accused Petitioners, who are co-villagers came and harvested the paddy crop resulting into theft case being lodged against the Petitioners.
Learned Counsel submits that the Petitioners being co-villagers have just helped Lal Singh in harvesting paddy crop with regard to one acre of land in possession of Lal Singh. It is submitted that the story set up by complainant is absolutely false as Lal Singh himself had filed a suit for specific performance for execution of the mortgage deed. It is further submitted that no offence is made out against the Petitioners. It is also submitted that Lal Singh has already been released on bail. Crl.M. No. 34249-M of 2010 #2#
Learned state counsel, on instructions from ASI Dharambir Singh, states that the Petitioners have joined investigation and their custodial interrogation is no longer required.
In view of the above, interim protection/bail granted vide order dated 22.11.2010 is made absolute.
Petition stands disposed of.
