The petitioner has approached this Court seeking an expeditious consideration of Ext.P4 representation filed by the petitioner seeking promotion to the next higher post.
The learned Standing Counsel appearing for the respondent bank would submit that the petitioner was reverted to the post of Clerk/Cashier and was thereafter again promoted to the post of Junior Accountant. It is submitted that since the petitioner has only presently been promoted, he may not have the necessary seniority to seek promotion to the higher post. It is also submitted that since the dispute raised by the petitioner clearly falls within the realm of Section 69 of the Kerala Co-operative Societies Act, the writ petition of this nature may not be maintainable.
Having heard the learned counsel for the petitioner and the learned Standing Counsel appearing for the respondents and considering the fact that the only request made by the petitioner is for a direction to the first respondent to consider Ext.P4 representation in accordance with the law, I am of the opinion that this writ petition can be disposed of directing the competent authority of the first respondent to consider Ext.P4 representation in accordance with the law, within a period of two months from the date of receipt of a certified copy of this judgment.
I make clear that I have not expressed any opinion on the merits of the matter and it is open to the competent authority of the first respondent to decide the matter in accordance with the law.
The writ petition is disposed of as above.
