Judgment
Arindam Lodh, J
Heard Mr. Deba Sharma, learned counsel appearing for the applicants/accused persons. Also heard Mr. Raju Datta, learned P.P. appearing for the State-respondent.
It is the case here that in a 10 wheeler container, various kinds of articles were loaded for transportation to Agartala from Assam State. The vehicle was checked at Churaibari Gate, Tripura. From the said 10 wheeler container, it was detected that there were 219 cartons and out of those cartons, 5 cartons were seized as those were containing contraband goods.
Learned counsel appearing for the applicants/accused persons has submitted that the accused-applicants being drivers had no knowledge about those cartons carrying contraband articles.
Mr. Datta, learned P.P. has submitted that those cartons were not loaded from the place the said 10 wheeler container was originated and from the statements of the witnesses, it was found that those 5 cartons were loaded from other places at the instance of the accused-applicants.
In view of this, I direct the Investigating Officer to produce sufficient materials as to wherefrom those 5 cartons were loaded in the said 10 wheeler container.
List the matter on 12.04.2024 for production of evidence in this regard.
