Judgment
R. Narayana Pisharadi, J
The petitioner is the accused in the case registered as VC 14/2016/SCE by the Vigilance and Anti-Corruption Bureau (VACB), Special Cell,
Ernakulam for the offence punishable under Section 13(1)(e) read with 13(2) of the Prevention of Corruption Act, 1988.
This application is filed under Section 482 Cr.P.C by the petitioner for quashing the proceedings in the above case registered against him by the
VACB.
When the matter came up for hearing today, learned Public Prosecutor submitted that, final report has already been filed in the case by the VACB
in the competent court and the court has also taken cognizance of the offence and the case is now pending before the jurisdictional court as
C.C.No.21/2020.
In the light of the aforesaid circumstances, I find that this application can be dismissed with liberty being granted to the petitioner to challenge the
final report filed against him, if he is advised to do so.
Consequently, the Crl.M.C is dismissed. The petitioner is at liberty to challenge the final report filed against him, if he is advised to do so.
