Judgment

By way of instant petition, petitioner has prayed for the following reliefs:
“i) to direct the respondent to re-fix the pay of the petitioner on promotion to the post of Lineman in the time-scale of Rs.4600-175-5300-200-6500-250-7250 by giving me the benefit of the provision of FR-22(I)(a)(1) and then re-fixing his pay in the revised pay scale of Rs.6400-20200 applicable w.e.f. 1.1.2006 and consequent retiral benefits including re-fixation of pension.
ii) to quash impugned order dated 19/08/15 Annexure-P/5 being arbitrary, void and illegal. ”
Though pleadings in the case are complete but before the case at hand, could be heard and decided on merits, learned counsel for the parties fairly submit that the issue raised in the instant petition stands adjudicated by a Co-ordinate Bench of this Court in Review Petition (Tribunal) No. 29 of 2020, titled Bihari Lal v. Himachal Pradesh Electricity Board Ltd., decided on 25.11.2021
Since issue raised in this petition stands set at rest by Co-ordinate Bench as taken note above, present petition is disposed of with consent of the parties, with the direction that the directions contained in Bihari Lal v. Himachal Pradesh Electricity Board Ltd , shall mutatis mutandis apply to the present case also. If found entitled to the benefits sought by the petitioner, same shall be released in his favour within four weeks from today.
Petition stands disposed of in the afore terms alongwith all pending applications.
