Judgment
Savitri Ratho, J
This application under Section 439 of the Cr.P.C. has been filed in connection with Phiringia P.S. Case No. 135 of 2023 corresponding to C.T. Case No. 550 of 2023 pending in the file of the learned S.D.J.M., Phulbani under Sections 147, 148, 341, 323, 324, 325, 452, 435, 436, 395, 332, 353, 307, 506, 120 (B), 201, 109, 149 of IPC read with Sections 25 and 27 of the Arms Act, read with Section 4 of the PDPP Act and read with Section 7 of the Criminal Law Amendment Act.
Mr. Suryakanta Dwibedi, learned counsel for the petitioners submits that the petitioners do not want to press this application as BLAPL No. 11772 of 2023 filed by them along with co-accused has been allowed on 18.10.2023. As BLAPL No. 11772 of 2023 has been filed on the same day as this application, this mistake has occurred.
Considering the said submission, the BLAPL is dismissed as infructuous.
It is unfortunate that the Registry has not pointed out about disposal of BLAPL No. 11772 of 2023. Copy of this order be sent to the Deputy Registrar (Judicial) for his information.
Urgent certified copy of this order be granted on proper application.
