This interim application is filed by the applicant detenue for interim release on the ground that he suffers from liver cirrhosis and for which proper treatment is available only in Kolkata. Previously the Government had considered such a ground and released him for a period of 30(thirty) days. He had undertaken the treatment and surrendered within time. His doctors have advised that he should visit again for further treatment.
Learned Advocate General for the Government submitted that in absence of documents being produced before the Government, the State authorities are not able to take any proper decision in this respect.
Under the circumstances, let the respondents produce the applicant before the State Medical Board, Agartala Government Medical College & G.B.P. Hospital, Agartala as early as possible. The Medical Board shall examine the applicant and give its recommendations to the Government with respect to further treatment needed and in particular state whether such treatment would be available in Agartala or not. On the recommendations of the Medical Board, the competent authority shall proceed further and pass appropriate order as found necessary.
With these directions, I.A. is disposed of.
