Heard Mr. Somik Deb, learned senior counsel assisted by Ms. R. Chakraborty, learned counsel appearing for the petitioner.

The petitioner is aggrieved by lowering of grading by the reviewing authority. The petitioner‟s performance has been graded satisfactory after altering the grading from very good in the ACR for the year 2019-20. Similarly, in the ACR for the year 2020-21, the reporting authority has observed that the petitioner is exceptionally qualified and remarked that he is „qualified‟. But the reviewing authority has certified him as “ACR recorded as Satisfactory (Good) doubtful integrity in many occasions”.

Now, names of 35 persons including that of the petitioner have been placed in the zone of consideration for promotion to the Grade-IV of Tripura Audit and Accounts Service. Apprehension of the petitioner is that for such lower grading, he may lose out from the recommendation of the Departmental Promotion Committee. It appears that even after receipt of those ACRs, the petitioner did not make the representation against those gradings by which he is apprehending adverse effects.

The petitioner is given three days time from today to file the representation to the appropriate authority by laying down all the grounds and the appropriate authority in response shall dispose of the said representation within a period of 7(seven) days from the day of receipt of the said representation.

In terms of the above directions, this writ petition stands disposed of. However, the right of the petitioner to approach this court if the petitioner is aggrieved by any order of the appropriate authority stands reserved.

There shall be no order as to costs.

A copy of this order be furnished to the counsel for the parties in the course of the day.
