Rule. Learned Additional Public Prosecutor waives service of rule on behalf of respondent – State.

By way of the present application, the applicant has prayed to release him on parole leave so as to enable him to complete the settlement process in connection with the order dated 11.03.2022 passed in CRMA J No.4333 of 2019.

Mr. Dineshkumar Prajapati, learned advocate for the applicant submitted that, out of Rs.4,24,000/-, now Rs.2,99,000/- remains to be paid. He further submitted that, the applicant is ready and willing to deposit Rs.50,000/- in 15 days. He further submitted that, if the applicant will be released on parole leave, he will deposit Rs.50,000/- before the Competent Court within a period of 15 days.

Having heard learned advocate for the applicant and considering the statement made by learned advocate for the applicant and the Jail record of the applicant-convict, the present application deserves to be allowed. The applicant-convict is ordered to be released on parole leave for a period of one month from the date of his actual release on usual terms and conditions as may be imposed by the Jail Authority.

The applicant-convict shall surrender before Jail Authority on completion of parole leave, without fail.

Rule is made absolute to the aforesaid extent. Direct service is permitted.
