Justice Kurian Joseph, C.J.—The writ petition is filed with the following prayer: It is therefore most respectfully prayed that in the facts and circumstances, the writ of mandamus may be issued and appropriate order or directions directing the respondents to consider the case of the petitioner under the Scheme (Annexure-P/1) be passed and records of the case be summoned for the kind perusal of this Hon''ble Court or any other order which this Hon''ble Court may deem just and proper may kindly be passed in the interest of justice.

It is submitted that the second respondent has not so far considered the case of the petitioner in terms of Annexure P-1, Scheme. There will be a direction to the second respondent to consider the case of the petitioner, after affording an opportunity for hearing to the petitioner and take appropriate action in accordance with law. Needless to say that the applicability of Annexure P-1, Scheme shall also be considered in the process and in case Annexure P-1 Scheme applies, all the eligible benefits under the Scheme shall also be extended to the petitioner. Needful action, as above shall be taken within a period of two months from the date of production of copy of this judgment along with copy of the writ petition by the petitioner before the second respondent.
