Heard on I.A. No.03/2021, application for grant of ad-interim bail.

This revision is filed under Section 102 of the Juvenile Justice (Care and Protection of Children) Act, challenging the order dated 17.03.2021 passed by

learned Child Court/ASJ (F.T.C) Raipur in Criminal Appeal No. 49/2021, in connection with Crime No 07/2021, at Police Station- Tikrapara, District-

Raipur (C.G.) for the offence punishable under Section 457, 380, 34 of I.P.C.

Counsel for the applicant submits that the applicant is juvenile & aged about only 14 years, after his arrest he was sent to the observation home, now

the applicant is tested Corona Positive and his health condition is not good, therefore, he be released on ad-interim bail.

Learned counsel for the Non-Applicant/State opposes the contention made by learned counsel for the applicant.

Considering the facts and circumstances of the case, age of the applicant and nature of offence, the fact that applicant is tested Corona Positive and

his health condition is not good, without commenting anything on merits of the case, the application (I.A. No.3/2021) for grant of ad- interim bail to the

applicant is allowed.

It is directed that the applicant shall be released on ad-interim bail on his natural guardian furnishing a surety of Rs. 25,000/- to the satisfaction of the

trial Court.

It is made clear that this order shall be operative till the 12 th of July, 2021. Thereafter, the applicant surrender on the said date before concerned

Court.

He shall strictly follow the COVID-19 protocol issued by the Central Government/State Government/Local Authority, he shall not involve himself in

any offence of similar nature in future or else this order granting bail to the applicant shall automatically stand cancelled without further reference to

the Bench.

In view of the above, I.A. No.1 application for urgent hearing and I.A. 2 application for hearing during summer vacation are disposed of.

List the case for final hearing in due course.
