Learned counsel for the parties are present.
Learned counsel for the petitioner submits that the case of the petitioner is squarely covered by judgment dated 04.09.2018 passed by this court in W.P. (S) No. 4922 of 2017 and he submits that under similar circumstances the relief as prayed for by the petitioner has been granted to the petitioner of W.P. (S) No. 4922 of 2017.
Learned counsel for the respondents has referred to the counter affidavit to submit that the petitioner claims to be working on the post of peon in P.P.K. College, Bundu and the service of the petitioner was absorbed by the University in another college namely B.N. Jalan College Sisai (Annexure-4 to the writ petition). He submits that in the counter affidavit relevant portion of Hon’ble Justice S.B. Sinha (retired) Commission report has been quoted wherein vide order dated 11.07.2014 he has dealt with the cases pertaining to Inter Department or Inter College Absorption.
Upon going through the judgment dated 04.09.2018 passed in W.P. (S) No. 4229 of 2017 it appears that the Justice S.B. Sinha Commission report or his order as referred to by the respondents in the counter affidavit were not placed before the Court.
At this, counsel for the petitioner prays for and is granted time till 24.08.2022 to file rejoinder to the counter affidavit.
