Heard Mr.Viral Shah learned advocate for the petitioner and Mr.Sahil Trivedi learned AGP who appears on an advance copy for the State.
The short issue involved in this petition is that by the impugned order dated 13.05.2021, the respondent No.2 seeks to enforce its order dated
02.02.2021.
Evidently, the order dated 02.02.2021 is a subject matter of challenge before the respondent No.1 by Revision Application No.35 of 2021.
When a communication of 13.05.2021 was received by the petitioner on 31.05.2021, the petitioner approached the Revisional Authority to take up
the Revision Application for hearing. It appears that, for reason that need not be gone into, the Revision Application has not been heard till date.
The respondent No.1 is directed to decide the Revision Application No.35 of 2021 within a period of four weeks from today. It is clarified that the
advocates appearing for the parties shall cooperate with the authorities for hearing of the Revision Application.
Till the final decision in the Revision Application is taken, the communication/order dated 13.05.2021 shall not be enforced.
Petition is disposed of. Direct service is permitted.
