Heard learned Advocate for the petitioners. He pointed out that petitioners are members of a Educational Trust and are valid voters. Elections for Managing Committee are to be held. That election programme is required to be sent through post or by hand well in advance to the members / voters. However, according to him, respondent nos.1 and 2 with ulterior motive and intention have not conveyed the programme by either of mode. That there is every possibility of managing unopposed elections.
On query raised by the Court as to when proposed elections are scheduled, learned Advocate fairly submitted that the elections are likely to be held in first week of February 2024.
Considering the above, there does not seem to be element of urgency as on today. However, in view of the apprehension entertained by the petitioners, learned Advocate is granted liberty to mention before Regular Court on 03-01-2024 by placing the matter in urgent category.
