Present petition has been filed for grant of revised pay scale to the petitioners for the post of JBT from due date and also for payment of summer/winter vacation salary to them for their period of service rendered by them during contract.
It has been submitted that first relief has already been granted by respondents to the petitioners by granting revised pay scale from due date.
So far as second relief is concerned, undisputedly, it is no longer res integra in view of Division Bench judgment dated 5.8.2008 passed in CWP No. 415 of 2000, titled as Baldev Singh & others Vs. State of H.P. & others, which has attained finality after dismissal of SLP of the State of H.P. by the Supreme Court. This position has also been reaffirmed in judgment dated 30.11.2010 passed in CWP(T) No. 6037 of 2008, titled as H.P. Rajkiya Prathmik Anubandh Adhyapak Sang Vs. State of H.P. & another.
In view of above settled position, respondents are directed to release the winter/summer vacation salary of the petitioner within six months from today, if not already released at the rate of pay scale as was admissible during the relevant period, failing which interest @ 6% per annum shall also be payable.
The petition is allowed and disposed of in aforesaid terms, so also pending application(s), if any.
