An application has been moved by the petitioner in the present case stating that while status quo order has been passed by this Court, during the
pendency of this writ petition, the boundary wall of the premises has broken and requires repairing.
Learned counsel submits that the petitioner may be allowed to repair the boundary wall at his own cost. Learned counsel submits that the petitioner
assures that no claim in equity or otherwise shall be made by the petitioner on account of such permission being granted by this Court.
Learned counsel for the respondents does not oppose the application.
Taking into consideration that there are certain parts of the boundary wall which have been broken and demolished, in order to protect the property, it
would be appropriate to allow the petitioner to reconstruct/repair the damaged/demolished part of the boundary wall for the purpose of safeguarding
the boundary wall. The said construction shall be at own cost without creating any equity in favour of the petitioner.
In view of above, the application stands disposed of.
