The learned Counsel for the petitioner seeks leave to add District Deputy Registrar Co-operative Societies, Jalgaon as party respondent.
Leave is granted. Amendment be carried out forthwith. On such amendment, issue notice to the newly added respondent. The learned AGP waives service for newly added respondent.
Heard the learned Counsel for the petitioner. The learned Counsel for respondent no.1 is present. The learned Counsel for respondent nos.2 and 3 are also present before the Court and seek leave to file their vakalatnamas.
Leave is granted as prayed.
The learned Counsel for the petitioner submits that the respondent no.3 is already disqualified for contesting the election which is to be held on 19.06.2022. The learned Counsel for the petitioner also pointed out that respondent no.1 is going to declare a list of eligible candidates on 06.06.2022 and if respondent no.3 being already disqualified is again allowed to contest the election, then there will be mockery of justice.
. However, ongoing election programme cannot be stalled. At the most, the petition can be heard in detail before the regular Court on an appropriate date fixed after mentioning the same before the regular Court. Needless to say that, since the order of turning down the objection raised by the petitioner is challenged in this petition, then the result of election would be subject to outcome of this petition.
At the request of the learned Counsel for the petitioner, list the matter on 21.06.2022.
