Seeking review/recall of an order passed by a Single Bench of this Court on 13.6.2013 in W.P. No. 1650/2013, this application for review has been filed. In the original writ petition, the petitioner non-applicant herein came out with a grievance that in the matter of appointment of LPG distributorship his claim in the quota fixed for the Scheduled Caste candidate has not been properly considered. After taking note of the grievance of the petitioner, without issuing notice to the respondent and without giving them any opportunity to give their say in the matter, taking note of the fact that an appeal against the allotment was pending, learned Bench thought it appropriate to direct the respondents to decide the appeal in accordance to law by a reasoned order within a period of 6 weeks.

Now it is pointed out by Shri V.R. Rao, learned Senior Counsel that the earlier process initiated for appointment of LPG distributorship was not completed, it was withdrawn/canceled due to certain reason and thereafter a fresh advertisement has been issued and the process is still pending. He submits that as first allotment process was not concluded, there is no question of deciding the appeal with regard to the same. However, he makes a fair statement that if petitioner has any grievance in the matter now after the second advertisement has been issued, and if that be done, the respondent Company shall consider it in accordance with law.

Keeping in view the aforesaid circumstances which has not come on record, the order passed by this Court on 13.6.2013 in W.P. No. 1650/2013 is modified to the extent that in case even now after issuance of second advertisement for distributorship if the petitioner has any grievance still subsisting, he may represent to the Grievance Redressal Committee within a period of 15 days along with certified copy of this order and on the same being done, the Grievance Redressal Committee shall consider the representation of the petitioner, take note of the grievance of the petitioner and thereafter take a final decision with regard to the allotment in question.

With the aforesaid, this review application stands disposed of. c.c. as per rules.
