Mr. Bharat Moossaddee has approached this Commission by filing the present First Appeal under Section 51(1) of the Consumer Protection Act, 2019 against the Order dated 10.03.2023, passed by the State Consumer Disputes Redressal Commission, Haryana (hereinafter referred to as “the State Commission”), whereby the State Commission has adjourned the matter the Consumer Complaint No.176/2019 to 18.05.2023 for recording evidence of the Opposite Party.
I have heard Ms. Ritu Singh Mann and Ms. Monika Jain, learned Counsel appearing on behalf of the Appellant and perused the impugned Order, the averments made in the Memo of Appeal as also the documents filed along with it.
The learned Counsel for the Appellant vehemently submitted that the State Commission has erred in law in granting adjournment and fixing the matter for 18.05.2023 for recording evidence of the Opposite Party, when the Opposite Party has failed to file its Evidence by way of Affidavit despite several opportunities and taken various adjournments. In my considered opinion, it is not a good ground to interfere with the impugned Order dated 10.03.2023, passed by the State Commission, whereby the Complaint case is fixed for 18.05.2023 for recording the Evidence of the Opposite Party. I hope that on that day the Opposite party shall appear and record its evidence.
The Appeal stands disposed of with this observation.
