This is first bail application filed by the applicant/accused under Section 438 of Cr.P.C for grant of anticipatory bail, who are apprehending their arrest
in connection with Crime No.12/2021 registered at Police Station-Dongargaon, Tehsil Gadarwara, District Narsinghpur(MP) for offences punishable
under Sections 452, 294, 427, 323, 506 and 34 of IPC.
In this case only offence punishable under section 452 of the IPC is non-bailable, the applicant has no criminal antecedent and looking to the facts and
circumstances of the case, the applicants' custodial interrogation is not required, therefore this application for anticipatory bail is allowed. It is directed
that if the applicant no.1 Bharat Kourav and applicant no.2 Arvind Kourav surrenders at the concerned police station within 15 days from today and if
they are arrested by the Investigating officer, they shall be released on bail on their furnishing a bail bond and surety bond for the sum of Rs.25,000/-
(Rs. Twenty Five Thousand only)each. If they failed to do so, the effect of this order shall be vacated automatically. They shall further abide by the
other conditions enumerated in sub-section (2) of Section 438 of Cr.P.C.
