In this appeal against the judgment and order dated 05.04.2021 passed in CBI Case No.2 of 2017, CBI vs. Sri Bharat Joshi and another, by the court of Special Judge Anti Corruption (CBI), Uttarakhand/First Additional Sessions Judge, Dehradun, the appellant has sought short term bail on the ground of the death of his mother.
Heard learned counsel for the parties and perused the record.
According to the learned counsel for the appellant, the appellant is the only son who has to perform the post death rites of his mother, who died on 11.03.2022.
Having considered, this Court is of the view that the appellant may be released on short term bail for a period of three weeks.
The short term bail application is allowed.
The appellant shall be enlarged on short term bail for a period of three weeks from the date of his release, on his executing a personal bond and furnishing two reliable sureties, each of the like amount to the satisfaction of the Court concerned. It is further directed that, on expiry of three weeks, the appellant shall surrender before the court concerned and an intimation to this effect shall also be given to this Court.
