Augustine George Masih, J.—Counsel for the Petitioner contends that the Petitioner was appointed as a Safai Sewak on temporary basis with the Municipal Council, Abohar on 25.12.1975. Thereafter, he was appointed on permanent basis on 30.4.1980 and he continued as such till the date of his retirement i.e. 31.1.2011. From the date of his retirement till date, no retiral benefits have been released to him, not even the pension which he is entitled to, has been released. Claiming the said relief, the Petitioner has filed a representation dated 7.4.2011 (Annexure P-3) but no decision till date has been taken thereon by the Executive Officer, Municipal Council, Abohar. He contends that the Petitioner, at this stage, would be satisfied if a direction is issued to the Executive Officer, Municipal Council, Abohar-Respondent No. 4 to consider and decide the representation dated 7.4.2011 (Annexure P-3) within some specified time.

Without going into the merits of the case or commenting thereon, the present writ petition is disposed of with directions to the Executive Officer, Municipal Council, Abohar-Respondent No. 4 to consider and decide the representation of the Petitioner dated 7.4.2011 (Annexure P-3) within a period of three months from the date of receipt of certified copy of this order. A speaking order be passed on the said representation and conveyed to the Petitioner forthwith.

In case, the Petitioner is held entitled to the retiral benefits, as claimed by him through his representation, the same be released to him within a further period of one month and the pension be released to him forthwith.
