Judgment
M.C. Sharma, J.—This revision petition has been filed by the petitioner against the judgment dt. 26.11.2010 passed by Additional Sessions Judge (Fast Track) No. 1, Ajmer in Cr. Appeal No. 233/2010, whereby he dismissed the appeal and the order dt. 05.08.2010 passed by Judicial Magistrate No. 4, Ajmer in Cr. Case No. 8/2009 convicting the petitioner for the offence under Sec. 138 of NI Act and sentencing him to undergo 6 months'' imprisonment together with direction to pay compensation of Rs. 60,000/- was, upheld. Both the lawyers i.e. Mr. Shobit Tiwari, counsel appearing on behalf of the accused petitioner and Mr. Peush Nag, counsel for the complainant respondent have jointly prayed to this Court that the parties have entered into the compromise and the complainant has received the amount of Rs. 60,000/- from the accused petitioner. The compromise application is annexed with this revision petition.
The accused petitioner as well as complainant, both are present in person in this Court and they are identified by their respective advocates. In view of the above statement made by both the lawyers present alongwith their respective parties, this revision petition is allowed and the impugned judgments passed by the Courts below are set-aside.
