Heard on main application filed under Section 439 of Cr.P.C. filed on 21.10.2020 for grant of bail on behalf of the applicant Bhanu Pratap S/o Jagat Ram, who is confined in custody since 09.10.2020 in connection with the Crime No. 680/2020 registered at Police Station, City Kotwali, District Khandwa for the offence punishable under Section 34 (2) of M.P. Excise Act.
It appears from the record that 98.640 bulk liters of English liquor has been seized from the possession of the applicant. It is submitted upon the basis of case diary that no any criminal background is available.
Therefore, looking to the first offence and the present situation arising out from the Covid-19 and other circumstances of the case, without commenting on merits of the case, the application is allowed.
Applicant Bhanu Pratap be released on bail upon his furnishing a personal bond in the sum of Rs.50,000/- (Rupees Fifty Thousand Only) with one solvent surety of the like amount to the satisfaction of the trial Court.
At the time of releasing from custody, all the instructions issued by the government related to Covid-19 shall also be followed by the concerned authority.
Accordingly, this M.Cr.C. stands allowed.
