Judgment
The present execution petition arises out of an Arbitral Award dated 03.05.2005, which was subsequently modified vide judgment dated 03.01.2007 passed by this Court under Section 34 of the Arbitration and Conciliation Act, 1996.
It is noted from the record that, subsequent to the judgment dated 03.01.2007, an appeal was preferred before the Division Bench of this Court. In view of the pendency of the said appeal, the present petition was adjourned sine die vide order dated 09.11.2009, with liberty to the parties to seek revival upon disposal of the appeal. The matter has remained pending thereafter.
Subsequently, the matter was listed on 29.01.2026, however, none appeared on behalf of the parties. Even today, despite the matter being called out twice, none appears for the parties.
In the absence of any appearance and since no steps have been taken to prosecute the present petition for a considerable period, this Court is not inclined to keep the proceedings pending indefinitely.
Accordingly, the present execution petition is dismissed for non-prosecution.
