Judgment
Learned counsel for the respondent No.1 has moved an
application on 12.05.2017 praying that on the averments made in
the application the appeal may be allowed and judgment and
decree passed by Addl. District Judge No.2, Udaipur in Civil
Original Suit No.48/2013 (Roopa Vs. Harji) on 09.04.2014 and
proceedings taken in accordance with judgment and decree
including registration of agreement to sale to subsequent persons
may be set aside.
Learned counsel for the respondents No.2 & 3 have no
objection in accepting the prayer of respondent No.1 Roopa S/o
Daula Ji Gamesti. This Court on 14.07.2017 has directed the
Deputy Registrar (Judl.) to verify the contents of application
No.1195/2017. The contents of the application were verified and
presence was marked on the same day.
Looking to the prayer made in the application No.1195/2017
and no objections of respondents No.2 & 3, this appeal is hereby
allowed and judgment and decree in Case No.48/2013 passed by
ADJ No.2, Udaipur on 09.04.2014 and steps taken further
pursuant to judgment and decree dated 09.04.2014 are set aside
and decree sheet be drawn.
In view of the above, the contempt Petition is also disposed
of.
