Judgment
B.C. Patel, C.J.—The present appeal is preferred against the order made by the learned single Judge in WP(C) No. 4593/1993 dated 27.9.2004
The main grievance of the appellant appears to be that he was qualified and he ought not to have been removed in the manner in which he has been removed. Learned single Judge has pointed out that there is an industrial forum available for the appropriate relief. It is required to be noted that the dispute in such cases cannot be decided by this Court, more particularly, when there is a question to be decided on appreciation of evidence about whether the certificate which was produced was bogus and it was produced by whom.
In our considered opinion, when there is an appropriate remedy available under the law, the learned single Judge has committed no error in not entertaining the writ petition. Hence, the appeal is dismissed. As we have examined the matter on merit, we reject the application for condensation of delay as well.
