Petitioners have assailed preliminary Notification No. BDA/COMMR/DC(LA)/SLAO/A5/PR/283/2008-2009, dated 30-12-2008 issued by respondent 2 under Section 17 of the Bangalore Development Authority Act, 1976 (Annexure-E to the writ petitions). I have heard learned Counsel for the petitioners and learned Counsel for the respondents and perused the material on record.
During the course of the submission, learned Counsel submitted that these writ petitions could be disposed in terms of the order dated 26-11-2014 passed in W.P. No. 9640 of 2014 and connected matters.
Submission is placed on record. In the aforementioned writ petitions, the relevant portion of the order reads as under:
"In that view of the matter, the notification dated 30-12-2008 assailed in these petitions are held as having lapsed as against the lands of the petitioners referred to in each of these petitions which were included in the said notification.
In terms of the above, these petitions are allowed to that extent. No costs".
In the circumstances, notification dated 30-12-2008 assailed in these writ petitions is held as having been lapsed as against the petitioners herein.
Writ petitions are allowed in the aforesaid terms. No costs.
