Judgment
ORDER
IA 5316/2025
The present application is filed by the Liquidator praying therein:
a. That this Hon’ble Tribunal be pleased to discharge the Applicant of his duties as the Liquidator of the Corporate Debtor;
b. That this Hon'ble Tribunal be pleased to appoint Mr. Brijendra Kumar Mishra bearing IBBI Registration No. IBBI/IPA-002/IPN00109/2017-2018/10257 as the Liquidator of the Corporate Debtor.
c. For any further of other reliefs that this Hon’ble Court may be pleased to grant in the interest of equity, justice and good conscience, for which act of kindness the Applicant as in duty bound shall ever pray.
It is submitted since the Liquidator has requested for replacement due to his ill health, the matter was put up before the CoC. The liquidator informed to the SCC that due to ill health, the liquidator would not be able to carry out the activities of the liquidation process. Thereafter, the liquidator requested the members of SCC to accept his resignation and relieve him from the duties of liquidator of Western India Metal Processors Ltd, the CD.
The erstwhile Liquidator of the Corporate Debtor, Mr. Ramesh Bhosale, is hereby directed to handover all the records, papers, information, data, status report, etc. whatever available with him in the Physical or Electronic format, to the newly appointed Liquidator of the Corporate Debtor forthwith, so that the Liquidator shall take effective control of Liquidation Process of the corporate debtor and shall take control of such other important information/documents that may impact Liquidation Process of the corporate debtor.
Consequently, the Liquidator Mr. Ramesh Bhosale is discharged from his duties and responsibilities as the Liquidator.
In view of the above, we hereby replace the earlier Liquidator with Shree Brijendra Kumar Mishra (IBBI/IPA-002/IP-N00109/2017-2018/10257).
Hence, IA 5316/2025 is allowed and disposed of accordingly.
