O R D E R
Ms. Aaushi Doshi i/b DS Law for the Applicant/ Resolution Professional in IA-683/2022 present. Mr. Abdullah Qureshi Ld. Counsel for the Respondent No.1 present.
Counsel appearing for the Resolution Professional submits that the CoC in its second meeting held on 07.12.2021 has approved with 100% voting in favour of withdrawal of CIRP of the Corporate Debtor. Counsel appearing for the Resolution Professional submits that the full amount of Resolution Professional fee has been received, and no claim is of Resolution Professional is pending against CoC/Corporate Debtor. Accordingly, withdrawal application IA-683/2022 is allowed.
The Corporate Debtor is brought out from the rigors of CIRP. The Resolution Professional is directed to handover the charge of the Assets and Affairs of the Corporate Debtor back to the Suspended Members of the Board of Directors.
Resolution Professional is discharged from his duties with immediate effect.
C.P. (IB)/2230(MB)2019 is dismissed as withdrawn. File be consigned to records.
