C. A. Rahim, J.—Heard learned counsel for the applicant and Learned A. G. A.

2.

It is surprising that since 78 months bail application of the applicant is pending and no order has been passed. In paragraph 7 of the affidavit it has been stated that after 1681995 more than 12 dates were fixed in the case but neither the aforesaid bail application was disposed of nor any order on the said bail application was passed by the learned VI Additional Sessions Judge, Meerut and bail application dated 981995 is pending for disposal in that court.

3.

It is unfortunate that the learned Additional Sessions Judge did not think it necessary to dispose of the application even if it is pending for the last 8 months. I is fortunate for him that up till now no application has been filed before the Government to obtain sanction to prosecute him under Section 342, IPC. Bit that does not take away the jurisdiction of the High Court to take administrative measures.

4.

The instant application is disposed of with the direction that the said bail application be disposed of within a week after communication of this order.

5.

A certified copy of this order be issued to the learned counsel for the applicant on payment of usual charges within two days.
