Judgment
Nirmal Yadav, J.—Ms. Preeta Bhatt, Advocate holding brief of Mrs. Beena Pandey, Standing Counsel for the Respondent No. 4 is present.
Heard.
Learned Counsel for the Respondent No. 4 states that directions issued by this Court vide order dated 19.03.2010 have been complied with.
In this regard, an affidavit has been filed by Sri Jitendra Kumar, Secretary, Secondary Education, U.P., Lucknow, wherein it has been mentioned that payment of leave encashment, 10% G.P.F., Provisional gratuity was paid to the Petitioner as per letter dated 25.09.2010 of the Principal, D.I.E.T., Bhimtal, Nainital.
Another letter dated 18.11.2010 of the Principal also reveals that remaining 90% amount of G.P.F. and insurance amount has already been paid to the Petitioner. The pension and commutation of the Petitioner''s gratuity has been calculated by the Finance Controller, Directorate of Secondary Education, U.P., Allahabad and also sent for appropriate action to A.G., U.P. vide letter dated 11.11.2010. Now payment is to be made by A.G., Uttarakhand through Treasury concerned, as the provisional pension is being received by the Petitioner from the State of Uttarakhand.
In view of the affidavit of the Secretary, Secondary Education, U.P., Lucknow, the grievances of the Petitioner has already been satisfied. The petition is disposed of.
