Judgment
Mr A. Kakati, learned Advocate appearing on behalf of the applicant along with Mr Jay Prakash Gupta, Interim Resolution Professional, are present.
The matter is not on board. However, it is taken up on board at the request of the Advocate appearing for the petitioner for the purpose of filing Interlocutory Application (I.A.83/2019) by the petitioner and also for passing appropriate orders thereon.
The above I.A.83/2019 is filed by the applicant for setting aside the final order dated 08.11.2019 whereunder the main Company Petition No.31/GB/2019 filed by the Financial Creditor was admitted and Mr Jay Prakash Gupta, CA was appointed as Interim Resolution Professional.
Subsequent to the disposal of the company petition, both parties entered into a settlement and the Financial Creditor has received the settlement amount by way of Postdated Cheques. In view of the settlement entered into between the parties, the applicant is praying for setting aside the order dated 08.11.2019.
Accordingly, the above I.A.83/2019 is allowed and the final order dated 08.11.2019 admitting C.P.(IB) 31(GB)/2019 and the consequential order appointing Interim Resolution Professional stands withdrawn.
