Judgment
Vinod Prasad, J.—Heard learned Counsel for the applicants and the learned A.G.A.
''I haven perused the order dated 4.5.2007 passed by Additional Sessions Judge (Room No. 15) Allahabad in case crime No. 122 of 1998, S.T. No. 892 of 2006, under sections 323, 147, 364, 365 and 467 IPC, Police Station George Town, District Allahabad.
In the interest of justice, I consider it appropriate to give one opportunity to the accused persons to crossexamine P.W. 1 Mahendra Kumar and P.W. 2 Smt. Reeta Mahto on imposition of cost of Rs. 1000/including the expanses of the aforesaid two witnesses. If the said cost and the expanses of the witnesses are deposited by the applicants in the Court within a period of a week from today, Trial Court is directed to resummon P.W. 1 Mahendra Kumar and P.W. 2 Smt. Reeta Mahto for their crossexamination by the accused and if the aforesaid witnesses are present and the accused does not crossexamine them, Trial Court will not give any further opportunity.
With the aforesaid direction, this application is disposed off finally.
