Judgment
M. Katju and Rakesh Tiwari, JJ.—Heard learned Counsel for the Petitioners and learned standing counsel.
The Petitioner No. 1 claims to be a non-political social organisation working for Hindu-Muslim unity and national integration, and Petitioner No. 2 is a lawyers organisation. In this petition, it is alleged that a Muslim Organisation is planning to hold a rally of Muslims on 7.10.2002 at Islamia Inter College Ground, Bareilly, and as a reaction, a Hindu organisation named "Hindu Shakti Dal'', Bareilly, is also planning for a ''Hindu Sammelan'' at Government Inter College, Bareilly, on the same date and time. Since both the colleges are in front of each other, it is apprehended that there may be a communal disturbance.
This country is a secular and democratic country and hence, there should not be any communal trouble as that would be against the interest of the nation.
The country must be free of communal and caste tension and this is absolutely essential for the progress of the nation. We must maintain the unity of the country.
We, therefore, direct the District Magistrate, Senior Superintendent of Police, Bareilly to see to it that there should not be any communal problem in Bareilly. What steps are to be taken in this connection is for the administration to decide, but it is their responsibility to do all that is necessary in this connection. The petition is disposed of.
The standing counsel will communicate this order to the District Magistrate and Senior Superintendent of Police of Bareilly. Let a copy of this order be given to the learned standing counsel free of charge by tomorrow.
