As directed vide order dated 17.2.2023, the petitioners have filed the amended petition as well as the memo of parties.
I.A. No. 3 of 2023
The petitioners have also filed I.A. No. 3 of 2023 seeking amendments of the writ petition.
The proposed amendment sought for is in paragraphs 4 and 5 of the petition. The State respondents as well as the Union of India do not have any objection to the proposed amendment.
Considered the proposed amendments.
The first amendment sought for is only a correction in prayer (iii) and (iv) of the writ petition. The proposed prayer - ‘1-a’, is a prayer seeking a direction to the State of Sikkim for constituting the Advocate’s Welfare Fund Trustee Committee as provided under section 4 of the Advocate’s Welfare Fund Act, 2001. As the State respondent does not have any objection to the amendment sought for, the amendments are allowed.
The petitioner shall file the amended writ petition within a week. Notice may be issued to the newly impleaded respondents after the amended writ petition is filed, subject to requisites within three days after filing of the amended writ petition.
Accordingly, I.A. No. 3 of 2023 is allowed and disposed of.
