Judgment
ORDER
I.A. 2814/2024 [Sec. 60(5)]
The admission order was passed on 21.01.2019. The Suspended Directors are responsible for filing the Annual Returns and the Financial Statements of the Corporate Debtor till 21.01.2019. Thereafter, the concerned RP was required to file the Annual Returns and the Financial Statements of the Corporate Debtor.
The Company was admitted into liquidation process vide order dated 15.12.2020, thereafter the liquidator is responsible to file the Annual Returns and the Financial Statements of the Corporate Debtor. 3. The Sale Certificate was issued in favor of the Successful Purchaser of the Corporate Debtor as a going concern during the liquidation process on 25.04.2023.
Therefore, the successful purchaser is responsible for filing the Annual Returns and the Financial Statements of the Corporate Debtor from 25.04.2023 onwards.
The applicant Mr. Jagadish R. Ladda submits that he has sent an email dated 19.12.2025 to the Ld. Counsel for the liquidator. The liquidator is present through VC, he may reply to the email of Mr. Jagadish R. Ladda
