IA No. 137/CTB/2020, this IA is filed by Resolution Professional Mr. Kamalesh Kumar Singhania under Rule 13 of NCLT Rules, 2016 for urgent hearing of IA No. 136/CTB/2020 under Rule 11 of NCLT Rules, 2016 and Section 60 (5) (c) of the IBC, 2016. Prayers are as follows –

"a)

Issue necessary orders directing urgent listing of the application for exclusion of time from CIRP period in the Cause List at the earliest date so that the said application may be taken up for hearing and appropriate order may be passed.

b)

Issue necessary orders confirming the exclusion of a period of 68 days i.e. from 25.03.2020 till 31.05.2020 from the CIRP period of the Corporate Debtor.

c)

Issue necessary orders confirming the exclusion of a further period of 61 days i.e. from 01.06.2020 to 31.07.2020 from the CIRP period of the Corporate Debtor.

d)

Issue necessary orders confirming the exclusion of any further period of lockdown, from the CIRP period, if the Government of India or the Government of Odisha, decide to extend the lockdown beyond 31.07.2020.

e)

Pass such other Order/directions as this Hon'ble Bench may deem fit and necessary in the facts and circumstances of the case."

Above prayers are ALLOWED.

Accordingly, IA No. 137/CTB/2020 is hereby disposed off.
