This unnumbered application in C.P. (IB) No. 132/KB/2018 has been filed by the Resolution Professional Santosh Choraria, under sections 19 of the Insolvency & Bankruptcy Code, 2016 against National Insurance Company Limited necessary directions upon the Respondent to make the payment of the arbitral amount of Rs. 5.67 crores and interest @ 18% per annum from 1st November 2014 till the date of payment and if the said amount has been paid or settled, then details of the same is to provided to the RP within 7 days from the date of the order thereof.

This application came up for consideration on today through video conference, due to disruption of work of the Tribunal due to Covid-19 pandemic and consequential lockdown. However, when this case was taken up for hearing it was brought to my notice that the e copy of the application forwarded to me from the registry is not the application in this unnumbered IA.

The Ld. Counsel Mr. Rahul Auddy, appearing for the Applicant Resolution Professional submits that the respondent is not assisting or cooperating with the RP and failed in submitting the information repeatedly demanded from the respondent and pressed for issuing directions to that effect.

Mr. Debajyoti Datta, Ld. Counsel for the National Insurance Company Limited, submits that the documents called for were in the custody of a different set of Advocates who is looking after the Arbitration case and its appeal, and prays for 15 days time for submitting the information to the RP. The submission is recorded. In case of any failure on the side of the respondent in fulfilling the submission th Rp is at the Liberty to move a similar application. With the above said observation this application is disposed of.

The Registry is also directed to send e-mail copies of the order forthwith to all the parties.
