Heard on the applications under Article 226 (3) of Constitution of India.

Learned Senior Counsel appearing on behalf of the respondents submitted that the respondents are making promotions of Officers belonging to various

Grades as per the promotion policy dated 02.12.2019. Counsel further submitted that in both these writ petitions the petitioners have not challenged the

promotion policy dated 02.12.2019. Counsel further submitted that the respondents-Bank is making the promotions of Officers of various Grades

throughout the country after amalgamation of Dena Bank and Vijaya Bank with the Bank of Baroda and for smooth functioning of the Bank,

Promotion Policy was introduced by them on 02.12.2019.

Counsel appearing on behalf of the petitioners have opposed the applications and submitted that the respondents are making promotions contrary to the

policy and in violation of promotion policy they have issued the circular dated 09/10.01.2020.

Heard counsel for the parties and perused the record. According to the information given by the Learned Senior Counsel, the written test for

promotion in question has already been conducted by the respondents and they are in process of making the promotions.

Considering the fact that the respondents are making the promotions of Officers of various Grades throughout the country for smooth functioning of

the Bank, I deem it just and proper to allow these applications in the interest of Bank and also in the interest of account holders.

Accordingly, the interim order dated 30.05.2020 passed in S.B. Civil Writ Petition No.5749/2020 as well as the interim order dated 05.02.2020 passed

in S.B. Civil Writ Petition No.1868/2020 are hereby vacated. However, any promotions made by the respondents-Bank for the post in question during

pendecy of the present writ petitions shall remain subject to final out come of these petitions.
