Alok Singh, J.—Learned counsel for the petitioners states that father of petitioner No.1 has got registered one FIR No.101 of 2010 in Police Station Miran Sahib, District Jammu, against petitioner No.2 for offences punishable under Sections 366/109 RPC. He further states that since both the petitioners are major and have married with their free will and consent, therefore, no offences punishable under Sections 366/109 RPC are made out against the petitioners. He further states that petitioners are not wanted in any other criminal case.

Learned counsel appearing for respondent Nos.4 and 5 states that let petitioners surrender/appear before the Illaqa Magistrate, R.S. Pura Jammu, and suffer a statement to the effect that they are major and have married with their free will and consent and there is no case of abduction/kidnapping.

Learned counsel for the petitioners contends that petitioners shall surrender/appear before the Magistrate at R.S. Pura Jammu within 20 days positively and shall make statement before him to the effect that both are majors and have married without any fear or pressure and petitioner No.1 is happy in the company of petitioner No.2 and has never been abducted or kidnapped.

Present petition is disposed of with a direction that petitioners shall surrender/appear before the Illaqa Magistrate at R.S. Pura within 20 days from today. Meanwhile, petitioners shall not be arrested pursuant to FIR No. 101 of 2010, lodged by father of petitioner No.1, under Sections 366/109 RPC.
