Banamali Mohanty vs State of orissa

IS a retired Government Servant. Not being able to get the pension, gratuity and commuted value of pension he has filed thIS complaint. On 11.2.93 the opposite party has intimated the Secretary of the CommISsion that the amount has already been released. It reads as follows: "Regarding the pension case of Sri Banamali Mohanty, Retd. A.O., I am directed to say that the Pension, Gratuity and Commuted Value of Pension have already been released by the A.G. OrISsa vide PPO No. 78010 and Communication No. 3661/9293. Regarding other claims the D.A.O., Sonepur has been intimated in hIS L. No. 2450 dt. 26.12.91, a xerox copy of the said letter IS enclosed herewith for your kind perusal."

THERE is no mention about the Provident Fund. Mr. P.K. Routray, learned Addi. Standing Counsel, on instruction submits that not only the Provident Fund but also an annual increment which complainant has to get is now ready. We direct that the complainant shall be intimated by the opposite party of the Provident Fund and the arrear salary payable to him within fifteen days from today by registered post intimating him the place where from he can receive the same. Complainant has stated that he is entitled to interest for delayed payment and delayed sanction. He may move the appropriate Forum for recovery of the same, if available under law. We are not inclined to give any direction to that effect in this complaint.

Complaint is disposed of with he aforesaid direction. Complaint disposed of.
