Memo of appearance filed by Mr.Subir Palit, learned Senior Counsel is taken on record.
This application has been filed by the petitioner praying for quashing of the F.I.R. in Jeypore Vigilance Case No.11 of 2002 corresponding to G.R. Case No.09 of 2022 (Vigilance) pending in the Court of the learned Additional Sessions Judge-cum-Special Judge (Vigilance) Jeypore, Koraput.
Mr.Palit, learned Senior Counsel submits that the petitioner is alleged to have misappropriated an amount of Rs.1,32,19,017/- (Rupees one crore thirty two lakhs nineteen thousand seventeen) and out of the said amount, the petitioner has already deposited Rs.18,00,000/- (Rupees eighteen lakhs) before the Court and will deposit a further amount of Rs.80,00,000/- (Rupees eighty lakhs) by 10th April, 2023 in the Court of learned Additional Sessions Judge-cum-Special Judge (Vigilance) at Jeypore, Koraput and he may be granted protection to do so.
In view of the said submissions, it is directed that till 10.04.2023 the petitioner shall not be arrested in connection with Jeypore Vigilance P.S. Case No.11 of 2022 arising out of Vigilance G.R. Case No.09 of 2022, pending in the Court of learned Additional Sessions Judge-cum-Special Judge, Vigilance, Jeypore in Koraput District.
