Judgment
Alok Singh, J.—This is an application u/s 438 Code of Criminal Procedure seeking anticipatory bail in a case FIR No. 134 dated 7.7.2010 under Sections 341, 324, 323, 326, 452, 506, 427, 148, 149 IPC registered at Police Station Salem Tabri, Ludhiana City, Punjab.
Affidavit of Sub Inspector Bittan Kumar is filed in the Court which is taken on record.
Ms. Bhavna Gupta, DAG Punjab on the instructions of SI Bittan Kumar has stated that no injury is attributed to the Petitioner and his custodial interrogation is not required. Learned Counsel for the Respondent - State has further stated that no specific injury has been attributed to the Petitioner except that he has thrown the victim from the roof of the house, however, no recovery is to be made from the Petitioner.
Considering all the facts and circumstances of the case, petition is allowed. In the event of arrest of the Petitioner, he shall be released on bail to the satisfaction of the Arresting Officer/Investigating Officer.
Petition stands disposed of accordingly.
