As per pleadings on record, petitioner joined service with the Municipal Corporation, Ludhiana as a Beldar in June 1992. Thereafter, petitioner has earned promotions to the post of Junior Engineer, SDO and Executive Engineer. Petitioner is stated to be currently serving on the post of Executive Engineer and is to superannuate in December 2020.
The short grievance raised in the instant petition is that a notice dated 14.03.2019 (Annexure P-1) submitted by the petitioner for premature retirement is still pending and no final decision thereupon has been taken.
It is the contention raised by counsel that no inquiry/ departmental proceedings are pending against the petitioner and the respondent-Authorities are not accepting the notice for premature retirement inspite of such request being covered under the provisions of Punjab Civil Services (Premature Retirement) Rules 1975.
Having heard counsel for the petitioner and without even ascertaining the correctness of the averments made in the petition, I deem it appropriate to dispose of the instant writ petition with a direction to respondent No.1/competent authority to take a final decision in the matter against the backdrop of the notice dated 14.03.2019 (Annexure P-1) as also the recommendation in favour of the petitioner vide memo dated 12.07.2019 at Annexure P-2. A final decision be taken in the matter and conveyed to the petitioner within a period of four weeks from the date of receipt of certified copy of this order.
