Judgment
This revision petition is directed against judgment dated 02.03.20200 passed by Learned Additiional Session Judge, Fazilka, affirming judgment and order dated 01.02.2018 passed by the court of Shri Amrrish Kumar, Sub Divisional Judicial Magistrae, Abohar, convicting and awarding sentence of rigoorous imprisonment of 02 years and a finee of Rs.5000/- to the petitioner on account of dishonour of a cheque in the sum of Rs.15 lacs.
Learned counsel for the parrties state that the parties have reached a compromise and the complainant-respondent (in the criminal revision) has no objection if the offence iss compounded. The complainant has been contacted from his mobile Number i.e. 9653155555 by Shri Ankush Thhakral, Advocate for respondent No.1 on his mobile number i.e. 92169508446 through Video call and has been identified by Mr.Ankush Thakral, Advocate. The complainant has unequivocally stated that he has received thhe entire amount of the cheque in question and has no objection if the offence is compounded and the petitioner is acquitted of the offence charged against him.
In the circumstances, the criminal revision petition is accepted, conviction and sentence of the petitioner as ordered vide judgment and order dated 01.02.2018 of Shri Amrish Kumar, Sub Divisional Judicial Magistrate, Abohar and affirmed by judgment dated 02.03.2020 passed by Learned Additional Session Judge, Fazilka, is set aside and the petitioner is acquitted of the offence of which he was so convicted and sentenced.
Criminal Revision Petition is disposed of in the aforesaid terms. File be consigned.
A copy of this order be sent to learned counsel for the parties.
